Duty of disclosure for sellers of real estate

On February 20, 2007, the Supreme Court pronounced their verdict in a case regarding real estate law concerning revocation of a real estate purchase (exclusive vacation home in Bohuslän) (case no. T 2832 05). The Supreme Court established that a seller of real estate, to a certain degree, should be obliged to inform the buyer of matters known to him and that the buyer should have discovered but has overlooked. In the particular case, the seller had neglected to inform the buyer of clearly disturbing noise from a nearby motocross track. The buyer, a Norwegian businessman, can now buy a new and exclusive vacation home in Bohuslän or some other place.
